PeopleBrowsr Vs. Twitter Legal Battle Returns to San - AllThingsD

twitter_bird_380PeopleBrowsr won a small victory in its ongoing litigation with Twitter on Wednesday, winning a decision to keep the case inside the state of California at the San Francisco Superior Court.

It?s a long, complicated history between the two technology companies, but here?s the gist: PeopleBrowsr relies on access to Twitter?s ?firehose? of raw data ? the millions of tweets flowing through Twitter?s pipes on a moment-by-moment basis ? to provide data analysis to PeopleBrowsr?s client base. Twitter decided to terminate the long-standing relationship with PeopleBrowsr last year, and planned to shut off direct access to the company.

To fight that, PeopleBrowsr took Twitter to state courts, alleging anticompetitive actions. Twitter argued that was a Federal court issue, and tried to parlay the fight over to a higher court of opinion. If successful, that could have invalidated PeopleBrowsr?s temporary restraining order ? which was filed in a California state court ? essentially terminating PeopleBrowsr?s access to Twitter?s firehose.

?Twitter?s inconsistent representations to the State and Federal Courts reinforce our case,? said PeopleBrowsr CEO Jodee Rich in a statement. ?Last week, they said this was a contracts issue. This week, it?s an antitrust issue,? said Rich.

So Wednesday?s development essentially means that Twitter?s strategy didn?t work. The case will continue on in San Francisco?s superior court.

?We believe this case is without merit and will vigorously defend ourselves against it,? a Twitter spokesperson told AllThingsD.

As Dow rallies, banks largely left behind

As the Dow rallies past its 2007 highs and hits its all-time record, there's one sector that's nowhere near its glory days: financials.

Nearly five years after the 2008 crisis, stocks of big U.S. banks remain badly bruised. Even the giant rallies financials stocks saw throughout 2012 did little to edge the sector close to where it peaked, some nine months before the benchmark indexes would reach all-time highs on Oct. 9, 2007.

Since then, the steep levels of capital on hand mandated by regulators has pinched banks' return on equity, and only one of the country's largest five banks has seen anything resemble a market recovery.

The most battered of the big banks: Citigroup. Shares of the nation's third-largest bank by assets were so troubled that, in March 2011, the bank executed a 1-for-10 reverse stock split ? a drastic measure to restore investor confidence. Even as Citigroup slashed costs, shed non-core assets, cleaned up its opaque balance sheet and replaced its chief executive, the stock is off roughly 91 percent from its 2007 highs.

Then there's Bank of America. A spate of mortgage settlements throughout the last year started chipping away at crisis-era litigation risk, lifting a big, longstanding overhang on BAC's share price. The bank is halfway through its massive restructuring initiative, dubbed "New BAC," which is expected to increase the bank's profitability. Those two factors helped Bank of America's stock rally roughly 50 percent over the last year to $11.62 ? still around 75 percent below its peak trading level in 2007.

A dearth of merger and underwriting activity has kept investment banks Morgan Stanley and Goldman Sachs far from the 2007 highs as well. The two banks are down around 60 and 30 percent, respectively, from the last time the Dow crossed 14,000.

San Francisco-based Wells Fargo, the nation's largest mortgage provider and arguably one of the most conservative banks where risk-taking is concerned, is teetering near its break-even mark of $35.95.

Only JPMorgan has managed to squeak by with any post-peak gains. The U.S.'s largest bank by assets got even bigger since the 2007 highs by coming to the rescue of two severely troubled competitors: In March 2008, it scooped up brokerage Bear Stearns for less than the price of Bear's New York City headquarters, and later that year, it bought Seattle-based lender Washington Mutual out of bankruptcy. Shares fell in mid-2012 amid the "London Whale" trading blunder, but have rallied roughly 50 percent since and is currently trading at multi-year highs.

One promising sign is the increasingly bullish stance that analysts and stock-pickers alike have taken on the financials sector going into the current rally. For the banks, it helps to have the world's third-richest man in your corner: Warren Buffett has famously stood by the banks, and currently holds warrants in Bank of America and Goldman Sachs, as well as a common equity stake in Wells Fargo that seems to keep growing.

As Buffett wrote to shareholders at the beginning of 2012: "The banking industry is back on its feet."

Its stocks are just far from the high-flying, high-leverage days of yore.

Curious about how a disease gets started? Researchers may soon be able to ?street view? the inner workings of the human body.

An international group of researchers have successfully created the most comprehensive map of the human metabolism, called Recon 2, which details how the body?s converts food into energy, and assembles all of the hormones and proteins that contribute to a normal day?s work for cells and tissues.

Genes may form the foundation of the human condition, but it?s their activity, in the shape of the products they make?? from enzymes and hormones to nutrients and signalling factors?? that dictate how cells interact with each other, and how body systems, such as the way we breakdown food into energy, operate. ?It?s like having the coordinates of all the cars in town, but no street map,? Bernard Palsson, a professor of bioengineering at the University of California San Diego (UCSD) Jacobs School of Engineering, and one of the authors of the paper said in a statemnt. ?Without this tool, we don?t know why peopel are moving the way they are.?

By putting together how genes and their products interact across entire networks, he and his colleagues are confident that Recon 2 could help to expose some of the still mysterious causes of diseases like cancer and diabetes, as well as lead to better treatments.

?Ultimately, I envision it being used to personalize diagnosis and treatment to meet the needs of individual patients. In the future, this capability could enable doctors to develop virtual models of their patients? individual metabolic networks and identify the most efficacious treatment for various diseases including diabetes, cancer and neurodegenerative diseases,??said Ines Thiele, a professor at the University of Iceland in a statement describing the work.

Recon 2 resembles a ?Google map? since it consolidates all the details of human metabolism functions into one interactive tool and allows users to zoom in to view as much detail, at a cellular level, as they want, or to zoom out to get a broader perspective of all the different metabolic reactions that might be involved in a particular function. Such analyses can reveal patterns in function that might not otherwise be obvious to scientists working on more limited projects. In a release describing the scope of the project, University of California San Diego officials wrote:

This is not unlike how you can get a street view of a single house or zoom out to see how the house fits into the whole neighborhood, city, state, country and globe. And just as Google maps brings together a broad set of data ? such as images, addresses, streets and traffic flow ? into an easily navigated tool, Recon 2 pulls together a vast compendium of data from published literature and existing models of metabolic processes.

As the name suggests, there was also a Recon 1, which mapped?3,300 metabolic transformations occurring in tissue and cells. Recon 2 more than doubles that number of metabolic activities by covering more than 7,400 different reactions. To develop Recon 2, the original group of researchers from?UCSD brought together research groups from around the world to contribute their findings and develop standards for the map.

Researchers are already excited by Recon 2?s potential in a number of medical applications, including the ability to trace gene expression patterns to specific metabolic pathways, which can lead to more useful targets for drugs that can intervene in these processes and alter the reactions that can lead to disease.

?Recon 2 allows biomedical researchers to study the human metabolic network with more precision than was ever previously possible. This is essential to understanding where and how specific metabolic pathways go off track to create disease,? said Palsson in a statement.

Although it is the most expansive map of the human metabolism available, it?s still not complete. According to the researchers, Recon 2 includes only about 1,800 genes of the estimated 20,000 protein-coding genes in the human genome, so there is plenty more to map in coming years.

The study was published in the journal?Nature Biotechnology.
